Terms & Conditions

These Conditions apply to all persons entering and making use of the Flow Music Festival Site (“the Site”).

 

Entry and Access

 

— Entry to the Site will only be authorised upon presentation of a valid ticket, pass, wrist band or accreditation issued by or on behalf of the Flow Music Festival Crew and, if required, photographic proof of identity.

— Under 16s and Students must bring proof of age as due to license conditions as they may be required to provide proof of age and/or a Student iD card or confirmation from their educational establishment prior to entry. Attendees under the age of 16 can enter the festival without a ticket but will receive a bracelet at the entry.
— Children will be permitted entry with one adult ticket holder. Parents and guardians assume responsibility at all times for minors on the Site who are attending with them.

— Ticket holders enter the Site at their own risk.

— The right to culture. Access for 1.50 € to cultural events for Kulturpass card holders. Kulturpass card holders must bring proof as due to license conditions . No presale possible for Kulturpass card holders.

— Access to certain areas of the Site is restricted to authorised persons only and/or may be subject to certain conditions. Non authorised persons must not enter into or make use of restricted areas unless specifically authorised so to do.

— All Attendees must fully comply with the direction of authorised stewards.

— The right to refuse admission are reserved to Flow Music Festival Crew in the event that it considers entry will constitute a risk, inconvenience or disturbance to others. Any person who is reasonably suspected by the Flow Music Festival Crew and its authorised agents of having committed, or being likely to commit, a criminal offence within the Site may be ejected from the Site at any time.

— Attendees are not permitted to bring drinks or food into the Event Area. However, water is allowed.

— Dogs are permitted but must be kept on a leash at all times. We highly recommend leaving your dog at home as festivals can be too loud for your pets. However, If you still choose to bring your dog, please ensure they are kept at a considerable distance from the speakers.

— The Flow Music Festival Crew reserves the right to limit items which may be brought to the Site and to search bags and persons before granting entry to the Site or certain areas of the Site. Attendees agree to such searches and the Flow Music Festival Crew reserves the right to refuse entry to, or to eject from the Site, anyone refusing to submit to such a search.

Prohibited Items and actions

 

Illegal Substances: Possession or use is strictly forbidden.

  • Glass Containers: No glass bottles, containers, or glassware of any kind.

  • Potential Weapons: Anything that could be considered a weapon, including sharp or pointed objects (e.g., knives, large corkscrews), and 'personal protection' sprays.

  • Sound Systems: Personal sound systems or amplified music devices are not allowed.

  • Unauthorised Recording: No unauthorised audio or video recording of the event. All images and sound recordings remain the property of the Flow Music Festival.

  • Dangerous Behavior: Any actions that could endanger others, including climbing scaffolding, flag poles, or trees.

  • Fly Pitching or Unauthorized Trading: Selling goods or services without permission will result in expulsion.

  • Bringing Drinks or Food: Attendees cannot bring their own drinks or food into the event area, except for water.

  • Use of Electronic Equipment: To avoid nuisance, electronic equipment or musical instruments must not be used in a way that inconveniences others.

Attendees found in possession of these prohibited items or engaging in prohibited actions may be refused entry or ejected from the site. Please respect these rules to ensure a safe and enjoyable festival for everyone.

Safety and Security

 

— Attendees must comply with the instructions of the Flow Music Festival Crew and or its authorised agents (including stewards and security staff).

— Music and amplified sound may be in excess of 100 decibels and prolonged exposure can damage hearing especially to young children and ear protection is recommended.

— Thieves may operate within the Site. Attendees should not leave money or valuables unattended in any area of the Site.

— Climbing scaffolding or any permanent or temporary structures, flag poles or trees is strictly prohibited.

Photography, Filming and Recording

 

— During the Flow Music Festival various filming, photography and broadcasting takes place on the Site. By attending the Festival, Attendees grant their permission, free of charge, for their image, likeness and voice to be included in pictures and/or on film and/or audio broadcasts or transmissions and their exploitation and advertising without compensation or credit. Attendees acknowledge that any such use under this condition, and their agreement to such use, shall last in perpetuity.

— Attendees on the Site acknowledge and agree that the Flow Music Festival is the sole legal and beneficial owner of any intellectual property rights (including copyright) in any images or material taken or recorded at the Site (including by Attendees) and hereby assign any rights they may have in respect of such images, material or recordings to the Flow Music Festival.

— Attendees waive all rights (including moral rights) in any such images, material or recordings. Attendees are entitled to use any images or material taken or recorded at the Site for their personal use but not for any commercial purposes or for the endorsement of any business or product.

— Still photographs, film, videotape or other audio-visual material recorded within the Site may not be sold, used or published commercially in any way whatsoever unless authorised by the Flow Music Festival Crew and may be confiscated by the Flow Music Festival Crew if such usage is suspected.

— The use of photographic equipment must not inconvenience any other person in the Site.

— Other than for private and domestic use, any persons attending the Flow Music Festival shall not record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of the Flow Music Festival, the Site or any match (including any results, statistics, information or other data in respect of the match, whether in whole or in part) or to assist any other person(s) conducting such activities. Recording or transmission in any form of moving image

— Dangerous behaviour, fly pitching or sale of any other goods or other unauthorised trading will result in immediate expulsion from the site.

— No unauthorised recordings of the event. All images and sound recordings remain the property of the Flow Music Festival.

Limitation of Liability

 

— Flow Music Festival shall not be liable for the loss or damage of vehicles, goods or other materials belonging to attendees, guests, artists and crew attending the Site.

— In no event shall the Flow Music Festival Crew or any of its servants agents or providers be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the Flow Music Festival whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise other than:

(a) in any circumstances where there is a breach of a legal duty of care owed Flow Music Festival; or

(b) in circumstances where such loss or damage is reasonably foreseeable result of any such breach; and

(c) to the extent that any increase in any loss or damage does not arise from breach by You of any of these Terms and Conditions.

— Notwithstanding the above nothing in these Conditions of Entry shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability, which may not by applicable law be excluded or limited.

— The Flow Music Festival will not be responsible for any theft, damage or loss to Attendee’s equipment and personal possessions.

— Flow Music Festival will not be responsible if Ticket Holders catch COVID-19 at the Festival or for any illness or death of any Festival Ticket Holders caused by COVID-19.

FLOW MUSIC FESTIVAL RESERVES THE RIGHT FOR ITS AUTHORISED EMPLOYEES, AGENTS, CONTRACTORS AND POLICE OFFICERS ACTING REASONABLY TO REMOVE FROM THE SITE (WITHOUT REFUND OR COMPENSATION) ANY PERSON WHO CONTRAVENES THE ABOVE ‘CONDITIONS OF ENTRY AND TERMS OF USE AND ANY PERSON WHOSE PRESENCE AND/OR BEHAVIOUR IN THE SITE COULD REASONABLY BE CONSTRUED AS DANGEROUS, A NUISANCE OR ANNOYANCE TO ANY OTHER PERSON IN THE SITE.

These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase, as purchase of Tickets constitutes acceptance of these Terms and Conditions. Entry to and use of the Flow Music Festival Site is subject to the “Conditions of Entry and Site Use” which can be accessed via the Flow Music Festival website.

General

 

— In these Terms and Conditions “We”, “Our” or “Us” shall refer to the Commune de Sanem and “You” and “Your” shall refer to such person purchasing a Ticket.

— Please note that access to the Festival Site is subject to holding a valid ticket and subject to the Conditions of Entry and Site Use which can be found at www.flowfestival.lu

— For the purposes here of “Ticket” shall mean a ticket or voucher which entitles the purchaser to acquire a corresponding wrist band at the Festival ticket office authorising entry to the Festival site (“Site”) corresponding to the Ticket purchased. Wristbands are not transferrable.

— We will not be responsible for any Ticket that is lost, stolen or destroyed. We only accept responsibility for Tickets bought from us. Any queries regarding Tickets purchased from ticket Agents must be directed to the relevant Agent from which the Ticket was purchased.

— It is not always possible to issue duplicate ticket(s). Duplicates may be issued at our discretion.

— Tickets must only be purchased for personal use and not be used for onward sale, advertising, promotions, contests or sweepstakes. Tickets are non-transferable between 19th and 21st July 2024. Wristbands or similar accreditation cannot be transferred.

Price and payment

 

— The price of the Ticket shall be the price set at the time We accept Your order. All advertised prices are inclusive.

— Credit/debit card fees may be charged per ticket.

Changes to festival and line up

 

— Flow Music Festival reserves the right to make alterations to the published line up and scheduled programme of events where reasonably necessary. Any required changes shall not entitled You to any refund of reduction in Price.

— We will use Our reasonable endeavours to notify You using the details You provided Us with at the time of ordering in the event that for any reason the Festival is cancelled. It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering Tickets to receive such notifications.

Refunds

 

— In the event that the Festival is not held or cancelled for any reason You will be entitled to claim a refund from Us in accordance with the following provisions.

— The refund for Ticket(s) equals the greater of the price paid by You to Us for such Ticket, or the face value of the tickets.

— Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets. We shall not be responsible for refunds of Tickets purchased through a third party.

— These Terms and Conditions do not and shall not affect your statutory rights as a consumer.

Liability

 

— In no event shall the Flow Music Festival Crew or any of its servants agents or providers be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the Flow Music Festival Festival whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise other than: (a) in any circumstances where there is a breach of a legal duty of care owed Flow Music Festival; (b) in circumstances where such loss or damage is reasonably foreseeable result of any such breach; and (c) to the extent that any increase in any loss or damage does not arise from breach by You of any of these Terms and Conditions.

— Personal arrangements including travel, accommodation or hospitality relating to the Festival which have been arranged by You are at your own risk. Unless otherwise stated in this clause, Flow Music Festival(s)’ liability to You in connection with the Festival (including, but not limited to, in the Festival of cancellation, shall be limited to the Ticket price paid by You including the per Ticket booking fee.

— Flow Music Festival shall not be liable for the loss or damage of vehicles, goods or other materials belonging to attendees, guests, artists and crew attending the Site.

— Notwithstanding the above nothing in these Conditions of Entry shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability, which may not by applicable law be excluded or limited.

Invalid tickets

 

— Any Ticket obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void. The holder shall not be entitled to receive a wrist band entitling entry to the Site.

— Any person seeking to use such a void Ticket in order to gain or provide entry to a Festival may be considered to be a trespasser and may be liable to be ejected and liable to legal action. Void Ticket(s) are non-refundable.

— Tickets may be subject to certain restrictions on entry.

— It is Your responsibility to ensure that You read all notifications displayed on Our website.

— No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour.

Health and safety

 

— Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Festival. If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Festival, prior notice should be provided when ordering Tickets. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.

Dispute resolution

 

— Any complaints about the Festival should be made promptly to the Commune de Sanem.

— If any dispute arises the Flow Music Festival Crew will attempt to resolve it. Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days, the parties may attempt to settle it by mediation. To, initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation.

Assignment

 

—We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.

Third parties

 

— Any person who is not a party to these Terms and Conditions shall have no rights under the Contracts.

Events beyond our reasonable control (force majeure)

 

— For the purposes of these Terms and Conditions, ‘Force Majeure’ means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, disease, fire, explosion, flood, theft of essential equipment, malicious damage, pandemic, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

Whole agreement

 

— These Terms and Conditions are the complete agreement between You and Us regarding this subject. They replace any previous agreements or discussions. By buying your ticket, you're agreeing that you understand and accept these terms fully. You also agree that you haven't relied on any promises or statements not included in these Terms and Conditions or directly communicated to you by us before you bought your ticket.
